Website quoting wrong price

A very reputable Golf reseller (one of the bigest on the web) is advertising a brand new set of irons (3-PW) only recently released that usually retail at around £450 for £122.99!!!!!!!!! As a clue it comes with three hybrids that usually retail for £129 each (£99 street price) - so your getting 3 of them plus 5 irons for the price of 1 hybrid!.

Now I know it's got to be a mistake, the set comes either steel shaft or Graphite shaft, the  Steel shaft is priced correctly at £399.99 but clearly they've made an error on the graphite shafted set at £122.99.

Oh, and free shipping!!!! 

My question is, if I order online they have to honour that price don't they?

In fact I've just noticed - they have indeed priced a whole set of irons for the same as they sell one hybrid!!

Well I've ordered, have receipt/confirmation etc so we'll see if a set of Adams A3 Graphite irons turn up @ £122.99!!

3/4/5 are Boxer hybrids (normally at least £100 each alone!) 6/7 Hollow back Irons and 8-PW Cavity Back.

Check the T&C's. If it says on it E&OE they you are beat. If not then you may have found yourself a bargain.

If there is an obvious mistake in the pricing, as in this case, then I don't think you can hold them to it. I'd be interested in the outcome though.

Most businesses do cover themselves for pricing mistakes in their T&C and do not have to honour it.  This happens a lot with electrical retailers. Some cynical consumers believe a few retailers do it on purpose (especially during holidays when no-one is in to correct the mistake) to get free publicity on deal websites.  

Legally, I think when you order you are only offering to buy at that price. The retailer has to 'accept' your order before it is deemed a legal contract for that price. Not completely sure what is constitutes accepting an order, but probably receiving payment and confirming delivery date. Note banks often 'reserve' funds for a purchase, so can seem like the retailer has taken payment before they actually have.

On a slightly different note, my pet hate with golf retailers who use the RRP to make their sale prices seem better than they really are. Blatantly misleading consumers by using the saving off the RRP to make it seem certain items are on sale, when in reality they are selling them at their everyday price still.

Well I couldn't find anything in the terms & conditions re E&OE - I assume by this you are referring to errors and ommissions?

Although the confirmation I received says Order status "Pending".

We'll see what happens next week!

Having just looked back at the site they have now changed the price to £299.99 - still £150 less than anyone else, glad I ordered last night! As I said - i'll see what happens.

When World of Golf took over the pro shop at my range from JJB they had a big opening day. Went up to nosey around and see what their prices were like. On the whole it was pretty much run of the mill but one price really caught my eye. They were selling a set of Wilson Ci6's with V2 graphite shafts for £189. The shafts alone probably cost more. I told a mate in the club about them and a couple of days later he goes to buy a set.

When he got to the till they were scanning at £349 but the boss man told the salesman he must sell them at £189 and to "get that bloody price changed."

 So my mate won a watch but I dont know how it goes online.

In Oct 2004 I was on Ebay a company in U.S.A were selling BigBertha 04 irons the savings were fairly good but not fantastic when considering postage and taxes.But they wer being snapped up at a fair old rate.Each time I put in what I felt was a realistic bid someone beat me.So I searched the web and found out the address of the American company.Told the boss man I had been on Ebay but that did not think we were saving that much what would be his best price He gave me a price which I took to be in pounds which was very good.So I struck a deal on the phone.The clubs arrived 6 days later I could not believe the price he had been talking Dollars. I phoned the company got a very nice young lady on the line told her what had happened asked her had they under charged me and if so I would forward any extra money they required.She said that if that was the price the boss had quoted that was the price.She just said its your lucky day enjoy the clubs. The  clubs were retailing in the U.K at the time for £599 I just checked my paypal a/c I got them for £241 including shipping and taxes.I hope you get the same type of deal

In theory if they do not honour the price then it is 'false advertising' and you could take it up with trading standards. They will prolly just say they did not confirm the order and it is not out of stock or some other poor excuse.

all of this falls under Sale of Goods Act in one way or another, which basically means that the price is an 'invitation', you offer at that price and the seller has to accept your offer to purchase. the arguments then start about what constitutes an acceptance, but taking your money is a pretty solid argument in most cases.

even in a store, the seller isn't obliged to sell at an incorrect price. you can refuse to sell at a price as long as you remove all product that is displayed at the incorrect price as soon as you discover the error. rectification can be made and the goods restocked to the shop floor at the correct price. most retailers will sell an item at the lower price in the interests of customer service, but there is no obligation.

simple contract law applies here. Advertising goods or services at any price is only an "invitation to treat", which means, as bazzason says, the seller isnt obliged to sell at a an incorrect price.

The question is, is there a contract here? A contract consist of offer and acceptance and must be supported by consideration (even, as the cliche goes, it's only a peppercorn).

I think you have a valid contract here. You've made an offer, the seller's automated system has accepted it and the consideration is there and you've paid it.

well some good news!

My order had stayed on "pending" for a few days until today, now states "in progress" - had a call to apologise as a delay in stock coming in, no mention of incorrect pricing only delivery will be made Monday!

so looks like I may be the owner of a set of Adams A3 irons.................i'll give them a try compared to my A2's otherwise ebay here I come either A2's o A3's!!

well after coming back from 3 great days golf in Portugal I find my credit card has been debited with £122.99 and a set of Adams A3 irons has been delivered to my office!!!

Can't wait to get back into work on Thursday to pick them up!

Hi Darren,

I Picked up on your thread early the morning after you posted - tracked the website down and ordered some for myself.

A set of Adams A3 irons were delivered on Thursday with £122.99 taken from my card.

They look like amazing clubs especially the boxer hybrids - I don’t think I can use them myself due to the shaft flex so im waiting for my old man to come and have a look at them as he has just taken golf up again.

All credit to the company for honoring the price - they certainly didn’t have to. I guess I will be looking at the site a lot more now so they will probably make up any loss they made on the sale in a short period - knowing the rate I buy stuff!

Walker if your Dad doesn't like them I will take them off your hands at cost price of course, I wouldn't expect you lto lose any money on this

unfortunately within 2 days they had increased the price to £399.99, so you missed out i'm afraid.
